General Regulations for Entering Films in the EoF Label 2013


Article 1 – Project profile

Eye on Films is a unique, global network of film professionals, which guarantees the circulation of a selection of first feature films in festivals partners in Europe and third countries, and the commercial exploitation of these films by distribution partners in Europe and third countries.


Article 2 – Objectives

The Eye on Films project follows several objectives:
- to build a network of festival and distribution partners throughout the world, in both European and third countries;
- to create a Label of first feature films composed of both European and non-European titles, selected by the EoF Partners with the support of well-known advisors;
- to ensure the screening of these EoF Films in the Festival Partners;
- to ensure the commercial exploitation by the Distribution Partners of these Films in each participating territory;
- to create synergies between Festival and Distribution Partners, in order to maximize the visibility, the promotion and the marketing of the EoF Films;
- to create branding and communication around the EoF Films through the Label, which will benefit to both Festival and Distribution Partners, and will bring a positive leverage in future discussions with rights holders and national film centers;
- to give online information and access to the EoF Films.

This new business model will definitively enhance the cinematographic diversity, promote debute films, and highlight emerging authors. This project specifically guarantees the theatrical exhibition of several films, by mutualizing the promotion in film festivals and at the occasion of releases by local distributors.


Article 3 – EoF Coordinator

Eye on Films is a project developed by Wide, a leading independent sales company, representing a library of more than 600 titles, features and documentaries, with a catalogue containing an impressive variety of movies from internationally acclaimed directors, and acquiring 10-15 new titles per year.

Article 4 – 2013 Edition

The third edition of the Eye on Films project will take place between the 1st of January 2013 and the 31st of December 2013.


Article 5 – Selection Committee

The selection of the Films to be part of the EoF Label 2013 is carried out by a commission of film professionals functioning as a Selection Committee, which is composed of the EoF Partners (list in annex) with the support of well-known advisors.

The Selection Committee's decisions are based on an outright majority.

Members of the Selection Committee, EoF Coordinator and advisors are sworn to secrecy.

Deliberations, votes and comments within the framework for the EoF selection process are strictly confidential even after the decisions have been officialised.


Article 6 – Submission requirements

Except special cases, all films submitted for the EoF project must fulfill the following requirements:
1 – Films should have been completed recently.
Only works completed after October 31st, 2012 are eligible for selection in 2013.
2 – Only debute films are eligible for selection. First films are preferred.
3 – Only feature films (fiction, animation…) and feature-length documentaries are eligible for selection.
Eye on Films does not accept short films or documentaries of less than 60 minutes.
4 – Films should be available on both 35mm and digital format (HD, DCP).
Before applying, Rights Holders must guarantee the availability of such material in both original version with no subtitles, and original version with English subtitles.
5 – Films should not have been previously shown over the Internet or broadcasted on TV or been commercially released (in theaters and/or on other media) outside their country of origin.
6 – Films which have been previously presented in a festival in their country of origin are eligible for selection, provided the fact that no other screening was arranged after the national premiere, inside and outside the country.

Films which have been previously presented for world premiere in a major festival after October 2012 (such as Busan, Sundance, Rotterdam, Berlin, Cannes, Locarno, Venice…) are eligible, provided the fact that no other screening was arranged after the world premiere, inside and outside the country.

Preferably, films should not have been previously presented at any festival or film event (except in the context of a film market) outside their country of origin, and especially not in the participating territories.

The EoF Coordinator reserves the right to submit to the appreciation of the Selection Committee a film which would not fulfill the above mentioned requirements, provided the fact that this film is considered as particularly relevant within the framework of the Eye on Films project.

N.B. It is possible to submit a working copy of the film.
When filling out the entry form, the Rights Holder should state if he is submitting the final version or a working version.


Article 7 – Who can submit a film?

Anybody can submit a film for EoF project.
Films suggested by the EoF partners or by the EoF curators will receive special attention.

All films submitted for the EoF project must fulfill the selection requirements detailed in the EoF Regulations.
Rights Holders (producers, sales agents…) must agree on the EoF Regulations and return the Entry form duly filled and signed, before applying.


Article 8 – Participation

The EoF Coordinator invites Films to participate to the EoF project.
Once selected by the EoF Partners, the Film will be officially announced to be part of the EoF Label.

The selection in the EoF project must remain strictly confidential until further notice from the EoF Coordinator.
Titles selected to be part of the EoF project 2013 will be officially announced either in a press conference or an official press release. Any exception must be approved in writing by the EoF Coordinator.

If your film has not been selected, the EoF Coordinator will do its best to inform you before the announcement of the program.

Although the EoF partners and curators may communicate with filmmakers and rights holders regarding their films, the EoF Coordinator reserves the right to make no comment on the reasons for not selecting a film.

Participation to the EoF project includes in particular:
- Publication on the EoF official website eyeonfilms.org, on associated webpages, and on all kind of marketing contents associated to the EoF project;
- Screenings in the EoF festival partners;
- Acquisition of the distribution rights by the EoF distribution partners.

Participation in the EoF project requires the unconditional adherence to its regulations as set out here. Producers, sales agents or other organisations submitting a film must ensure that they are legitimately entitled to enter a film in the festival.


Article 9 – Special Conditions

No film selected for the EoF Label may be withdrawn from the project after its participation has been officially confirmed by the Rights Holder.

Once a Film is submitted to the Selection Committee, it is understood the Rights Holder has accepted the EoF terms and conditions.

More specifically, in case the Film is confirmed to participate to the EoF project, the Rights Holder commits:
- to guarantee the national premiere of the Film to the EoF festivals in each participating country;
- not to request screening fees to the EoF festivals for the screenings of the Film;
- to provide EoF festivals with the requested screening material;
- to give a first option of purchase of the Film to the EoF distributors in each participating country (all rights);
- not to request minimum guarantees for the purchase of the Film to the EoF distributors outside the framework of the sales estimations (see annex).


Article 10 – EoF Fund

It is agreed by all the parties that a commission of 5% on all gross receipts incomes generated by the sale of an EoF Film within the framework of the project, will be automatically transferred to a dedicated Eye on Films bank account which will be designated by the EoF Coordinator.

Such revenues will consist in specific, dedicated, EoF Fund which should not be used outside the framework of the EoF project.

In case of the sale of an EoF Film within the framework of the project, it is agreed by all the parties that the Buyer (distributor and/or broadcaster) will receive an invoice issued by the EoF Coordinator, corresponding to the 5% EoF fund commission. This sum should be transferred to the EoF bank account immediately after the signature of the Long Form Agreement between the Buyer and the Rights Holder.
It is understood that the Buyer will address the corresponding sum of the sale to the Rights Holder, decreased of the EoF Fund commission of 5%.

Depending on the needs, the EoF fund should be used in order to financially support specific activities such as:
- the promotion of the EoF Label and/or of the EoF Films in international markets;
- the participation of EoF films in EoF festivals;
- the P&A costs associated to the distribution of EoF films;
- the organization of workshops with EoF partners and/or the participation of EoF partners in existing workshops;
- the development of EoF directors' upcoming projects.


Article 11 – Material Requirements

Once a Film is confirmed to participate to the EoF Label, the Rights Holder commits to provide to the EoF Coordinator the material below, free of charge:
- a detailed description of all elements deposited in the laboratory of origin;
- delivery and free access to a copy 35mm subtitled in English that will be used for screenings at international film markets, at EoF festivals and at the occasion of other EoF events;

35mm prints should be sent to the following address:

- delivery and free access to a HD master and DigiBeta subtitled in English that will be used for screenings at international film markets, at EoF festivals and at the occasion of other EoF events;
- delivery of and free access to one DCP (if available);
- delivery and free access to one master HD and one DigiBeta PAL in original version 16/9;

Digital material should be sent to the EoF Coordinator's office in Paris:

- the dialogs list corresponding to the final edited copy in original version and in English;
- the list of the existing subtitles (in all available languages), as well as the spotting lists (in original version and in English);
- the Affidavit;
- the Certificate of origin;
- English and French synopsis;
- 5 posters (in all formats used for the promotion of the movie), optional;
- press kit in original version and in English (CD Rom, electronic);
- 1 CD Rom of the poster of the Film (CD of the artwork with the layers with all the logos and credit separated);
- 1 CD Rom of Exploitation photos (at least 15 photos in high definition, copyrights cleared);
- a photo in high definition and the director's biography;

Delivery of the material (35mm prints, digital material):
The sender should notify the EoF Coordinator by e-mail of the title of the film, date and means of shipment, the shipment number or airway bill number.

Shipping and insurance costs as well as customs taxes and customs broker's fees, including "temporary admission" rights are at the expense of the Rights Holders.

The responsibility of the EoF Coordinator covers the cost of storage and insurance in our lab only.


Article 12 – Submission process

Films will only be considered for selection after the entry form, duly filled and signed, is received by the EoF Coordinator, and in certain cases after the entry fee is received.

The EoF Coordinator has the right to settle any cases not covered by the regulations.

Films are to be submitted in their original version with English subtitles for the selection process.
Films in English do not require translation.

It is possible to submit a working copy of the film.
When filling out the entry form, the Rights Holder should state if he is submitting the final version or a working version.

Deadlines
There are no deadlines for submitting films. The EoF Coordinator will accept entries all year long.

Eligibility
Only films which fulfill the Submission Requirements detailed in the EoF General Regulations (Article 6) will be taken under consideration.

Entry form
Any submission of a film must include the Entry form duly filled up and signed by the authorized Rights Holder.

Films will only be considered for selection after the Entry form is received.

Pre-selection – Cinando Online Screening Room
The selection process is carried out through Cinando's Online Screening Room facility.

Cinando's Online Screening Room is an extra secured environment. Watermarking the viewer's name tracks the origin of any illegal copy. It guarantees a protection against piracy and an exclusive professional use.

Cinando's Online Screening Room is free, instant, secure and easy to use.

Rights Holders should upload the submitted Film with ease.

Once the upload process is complete, notify submission@eyeonfilms.org

Rights Holders who are not registered on Cinando can submit films on DVD under special conditions (see below).

Pre-selection – DVD
In certain cases, the EoF Coordinator can accept submissions on DVD.

Any submission of a film on DVD must include payment of entry fee of € 100 (one hundred euros).

All payments must clearly indicate the title of the film.

The EoF Coordinator will also accept payment of the entry fee by check, only if drawn from a French bank.
Check must be payable to 'Wide – Eye on Films' and included with the DVD.

Films submitted on DVD will only be considered for selection after the entry fee is received.
Entry fees are not refundable.
DVDs must be sent directly via courier or (air) mail to the EoF Coordinator's office in Paris at:

The full cost of sending DVDs for selection, including customs fees and insurance, as well as their return freight, must be borne by the producer or his authorised representatives.

The sender should notify the EoF Coordinator by e-mail at submission@eyeonfilms.org of the title of the film, date and means of shipment, the shipment number or airway bill number.

After receiving the DVD, the payment of the Entry fee and the Entry form duly filled and signed, the EoF Coordinator will proceed to the encoding and uploading of the Film on Cinando Screening Room Online, in order to submit the Film to the appreciation of the Selection Committee.

All DVDs submitted for selection will be returned only at the express wish of the owner and at the owner's expense. Requests for return of material can be made to submission@eyeonfilms.org up to six months after the submission.

Upon explicit demand, the submitted material may also be destroyed by the EoF Coordinator. In this case it is similarly necessary to send the respective instruction to submission@eyeonfilms.org within six months after the submission.


Article 13

The EoF Coordinator makes decisions in case of unclear situations or cases unforeseen in these regulations in conformity with the international regulations.


Article 14

Participation in the EoF project implies the entire agreement with the regulations set out herein.
